The Platform

Welcome to Shortletstays’ website www.shortletstays.net (‘Platform’). The Shortletstays Platform is a product of and provided by 2getha Assets Limited (‘2getha Assets ’). 2getha Assets is the owner of several luxury fully furnished properties available for short let.

These Terms and Conditions (‘Terms’) are between 2getha Assets /Shortletstays (‘Shortletstays’ ‘us’, ‘we’, or ‘our’) and a user who accesses or subscribes to the Platform (‘Guest’, ‘you’ or ‘your’). These Terms outline the terms and conditions of our relationship with you, as supplemented by our Privacy Policy. By using or subscribing to the Platform, you agree to be bound by the following terms and all applicable laws and regulations. These Terms and any relevant specific terms govern your use and access to the Platform.

Shortletstays reserves the right to modify these Terms at any time at its sole discretion. You are encouraged to review the most current terms and any relevant specific terms each time you visit the Platform. Your continued use of the Platform after such changes are implemented constitutes your acknowledgment and acceptance of the changes. If you do not wish to be bound by these terms, do not use or access the Platform or use our Services.

Your use or access of the Platform in any way signifies your constructive and actual notice and knowledge of, and your agreement to be bound by, the most current version of the Terms as posted on the Platform and our Privacy Policy. It is solely your responsibility to ensure that your use of any and all third-party Platform or content is in compliance with any and all third-party requirements.

Eligibility to use the Platform

In order to use or access the Platform or subscribe/register for our Services, you represent and warrant that you are at least 18 years of age and are legally able to enter into a binding contract.

You authorise us, directly or through third parties, to make any inquiries we consider necessary to validate your identity.

User Representation

You represent, warrant and agree that no materials of any kind submitted through your Account or otherwise posted or shared by you through the Platform will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libellous, defamatory, fraudulent or otherwise unlawful material. You further agree not to collect email addresses or other contact information of other users from the Platform by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from the Platform or for any other purpose.

You further agree that you may not use the Platform in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Platform

About our short let properties

  • Our short let properties are furnished and equipped to high standards. From time to time, we may change the layout, furniture or fittings and we will try to update these on the Platform at the earliest opportunity and notify Guests if the changes to the properties change the nature of the accommodation.
  • Differences between the description and photos on the Platform and those actually found at the property do not constitute a basis for cancellation, refunds or other claims against us. We will not be liable to Guests in the event of changes made to a property by us and not notified Guests.
  • Internet connection is provided at our properties. There is no charge for normal use of this facility. If a loss of internet connection occurs, we will endeavour to get you reconnected as quickly as possible but we cannot be held liable for any losses resulting from the loss of internet connection.
  • Unless otherwise specified, the prices quoted for all serviced properties include utilities.

CHECK-IN/CHECK-OUT TIMES

  • Check-in is from 3pm
  • Check-out is till 11am

BOOKING & PAYMENTS

  • Full pre-payment of the total cost of the booking is required at the time of making the reservation.
  • Bookings for accommodation purposes will warrant a minimum daily rate as communicated to you during your booking enquiry.
  • Bookings for video shoots, photoshoots or for more than 8 guests / people and no more than 12 guests / people at a time will warrant a 50% premium on the daily rate.
  • A booking is not confirmed until you receive confirmation from us.
  • All bookings are exclusive of VAT and you must pay 7.5% VAT on your daily rates.

CANCELLATIONS AND ALTERATION REQUESTS

  • Payments made for confirmed bookings are non-refundable.
  • Any cancellation or modification of a booking must be notified by the Guest providing a written notification of the cancellation or modification to Shortletstays.
  • Guests are allowed one free change of their reservation dates up to 14 days before the check-in date subject to availability. Any subsequent alteration requests will attract a payment of 50% of the booking amount.
  • The non-payment of any booking balances results in automatic cancellation.
  • Cancellations cannot be made once the guest has checked-in and all booking payments are non-refundable after the guest has checked-in.
  • If we cancel a confirmed booking, we shall do our utmost to find a replacement property acceptable to the Guest, or refund any monies paid on unused rental. The Guest agrees and acknowledges that in this event, Shortletstays’ liability for damages will be limited to the amount of unused rental, based on a pro rata calculation of

unused rental days. Should a property become unserviceable prior to the arrival of a Guest, we will do our best to find a suitable replacement property of an equal standard. In the event of a more expensive property being selected, the Guest will have the choice of paying the difference or receiving a full refund of monies paid.

NO SMOKING

We operate a STRICT No Smoking Policy in all our apartments. Smoking is permitted outside the apartments but never inside. If you do smoke outside on the balconies you must ensure you must not litter it with cigarette butts. There will be a N200,000 fee for thorough cleaning services charged to any guest who chooses to smoke inside the apartment or other indoor area, to restore it back to its original condition.

NO PARTIES OR GATHERINGS

We have a strict ‘No Parties or any type of Gatherings’ policy. Any guest who contravenes this policy will be requested to leave the apartment without refund and will also have to pay a fine of N250,00.

NO PETS

We do not allow pets in our apartments. Any guest that brings pets into the apartment without our knowledge will be requested to leave the apartment without refund and may also have to pay a fine of N250,00.

APARTMENT OCCUPANCY

All our apartments have a maximum number of guests allowed per stay. Guests are allowed to have friends/family over for visits of course but no overnight stays! There will be a penalty of up to the nightly rate of the apartment for every night that this policy is breached.

WiFi ACCESS

There’s free WiFi in all our apartments. The WiFi access code is subject to change without notice. Unfortunately WiFi internet is not the most reliable in Nigeria and sometimes guests can experience difficulties browsing due to downtime from the service provider. Shortletstays assume no liability for guest use.

QUIET HOURS

Our apartments are located in serene residential estates. In order not to disturb our other guests and neighbours, quiet hours are observed from 10pm. Televisions, loudspeakers, and voices must be kept at a respectful low level at all times.

PARKING

Free parking is available inside the compound for our apartments. However there are limited parking spaces and sometimes guests might be required to move their cars for other guests or neighbours to have access. Shortletstays assumes no responsibility for cars parked in our premises. Guests park their cars at their own risks.

DAMAGES

  • Except in the case of normal wear and tear, guests are responsible for any damage to the apartment or its contents during their stay, which has occurred due to thenegligence, willful default or irresponsible behaviour on the part of guests occupying the apartment, or their visitors.
  • All security deposits are fully refundable provided there are no damages to the booked Shortletstays property by the guest.
  • A guest may not remove any of the furniture or effects from the properties and will be liable for any furniture or effects damaged or missing from the properties. Furniture must be returned to its original position.

REFUNDABLE SECURITY DEPOSIT

We will request a refundable security deposit of up to the nightly rate of the apartment booked (or more depending on the length of the reservation). The security deposit will be returned to the guest usually from 48 hours after checkout time on the condition that:

(1) No undue damage to the apartment/building has occurred, by any guest in the party (2) No loss or undue damage to any property/items has occurred, by any guest in the party (3) No undue disturbance to other guests or residents has occurred, by any guest in the party

(4) No Pets have been in the property

(5) There has been no smoking inside the apartment during the stay period

(6) The maximum occupancy for the apartment has not been exceeded

(7) There has been no extended checkout time that wasn’t previously agreed

If the cost of restoring any loss or damage exceeds the value of the deposit, then Shortletstays reserves the right to seek recovery of the difference from the guest.

We have the authority to withhold or deduct monies from the security deposit or credit card to remedy any damage, excess cleaning, missing items, excess utilities caused by the Guest or to send an invoice for such monies to the Guest by email for immediate payment.

FORGOTTEN ITEMS

We expect guests to do a thorough check of their apartments before leaving the property to ensure no items/ personal possessions have been left. We will make efforts via email to contact the guest if we become aware of anything that has been left, within 24 hours. It is the responsibility of the guest to retrieve any item(s) from us. If any item remains with us for more than 30 calendar days since the date of departure and no attempts have been made to retrieve the item, Shortletstays will donate or destroy the item.

SECURITY CAMERAS

Security cameras are placed inside the compounds and outside the apartments. Video surveillance is carried out for the guests’ and staff’s personal security and to ensure the high standard of service.

ENERGY CONSERVATION

  • To conserve energy guests are required to turn off water-heaters after taking a shower, and turn off all Air-conditioners, lights and other appliances before stepping out.
  • This is a non-exhaustive list of general policies upheld by shortletsays. Should you require any clarification on terms not stated here, please contact us directly. shortletstays reserves the right to add to, alter or amend any of the above terms, conditions and rules as and when it deems necessary.

RIGHT OF ACCESS

Our representatives and subcontractors have the right of access to the property at any time, with due regard to your convenience, for the purpose of inspection of the properties and to carry out any essential repair or maintenance work.

DISCLAIMERS

We do not promise that the Platform or any content, service or feature of the Platform will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the Platform will provide specific results. The Platform and its content are delivered on an “as-is” and “as-available” basis. All information provided on the Platform is subject to change without notice. We cannot ensure that any files or other data downloaded from the Platform will be free of bugs or viruses. We disclaim all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose. We disclaim any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the Platform. You assume total responsibility for your use of the Platform.

LIMITATION OF LIABILITY

Under no circumstances shall we be liable to you for any indirect, consequential, exemplary, incidental or punitive loss or damages arising from your direct or indirect use of the Platform. Guests acknowledge that they are responsible for taking all necessary safety precautions for

themselves and their guests and neither Shortletstays accept any liability for accidents causing death, sickness or bodily harm to whatever extent caused. 2getha Assets and Shortletstays deny any liability or claims in the event of incidents occurring whilst occupants or guests are under the influence of alcohol or drugs. The limitation of liability for any claim against us is limited to the total amount of rental paid to us by the Guest. We will not be liable for any delay, loss, damage or expenses incurred if your booking needs to be altered or cancelled or we are unable to perform our contractual obligations as a result of events beyond our reasonable control, which shall include but not be limited to events such as war, civil strife, terrorist activity, labour disputes, natural or man-made disaster, fire, flood, and adverse weather conditions

WAIVER & SEVERABILITY

Our failure to enforce a provision of these terms is not a waiver of our right to do so later. If any provision of these terms is found invalid or unenforceable by any court of law, the invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions of the terms, which will remain in full effect and an enforceable term or terms will be substituted reflecting our intent as closely as possible. No waiver of any of these terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

GOVERNING LAW

All matters or disputes relating to your access to or use of the Platform, or arising from the

booking of accommodation with us, will be governed by the laws of The Federal Republic of Nigeria and the Nigerian Courts shall have exclusive jurisdiction to determine such disputes or matters.

By deciding to book and stay in any of our apartments, you agree to accept our terms and conditions stated below.
